The President has amended the previous Executive Order issued on February 1, raising the additional tariff from 10% to 20%.

Tariff Details:

  1. Tariff from Feb. 4 to March 3:

    • For products from China and Hong Kong entered or withdrawn from warehouse for consumption between 12:01 a.m. ET on February 4 and March 3, the additional tariff will be 10%.
    • Importers should use HTS code 9903.01.20, with exceptions for:
      • Products under HTS 9903.01.21 (donations)
      • Products under HTS 9903.01.22 (informational materials)
      • Products under HTS 9903.01.23 (goods in transit with a grace period until March 7 for goods “loaded onto a vessel or in transit” prior to February 1)
      • Personal use goods.
  2. Tariff from March 4 Onwards:

    • Starting 12:01 a.m. ET on March 4, the additional tariff increases to 20%.
    • Importers should use HTS code 9903.01.24, with the same exceptions as listed above (donations, informational materials, goods in transit with grace period, and personal use goods).

Grace Period for Goods in Transit:

A grace period is available for goods that were:

  • Loaded onto a vessel or in transit before 12:01 a.m. ET on February 1, 2025.
  • These goods will not be subject to the additional tariffs, even if they are entered or withdrawn from warehouse for consumption after February 4. However, this exemption applies only until 12:01 a.m. ET on March 7, 2025.

After March 7, these goods will be subject to the new tariffs.

To claim the exemption, importers should use HTSUS 9903.01.23.
